1. Scope

These Terms and Conditions apply to all orders placed via our online store by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade or profession.

3. Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer.

By placing an order, you submit a binding offer to purchase the selected goods.

The contract is concluded when we accept your order by sending an order confirmation via email.

4. Prices and Shipping Costs

All prices are final prices.

If applicable:
According to §19 UStG (small business regulation), no VAT is charged.

Shipping costs are displayed during the checkout process.

5. Delivery

We deliver worldwide.

Delivery times are indicated on the respective product pages.

If a product is unavailable, we will inform you without delay.

6. Payment

We offer the following payment methods:

• Credit cards (Visa, Mastercard, Maestro)

• Apple Pay

Payment is due immediately upon order confirmation.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal.

9. Warranty (Gewährleistung)

The statutory warranty rights apply.

10. Liability

We are fully liable for damages caused by intent or gross negligence.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations, limited to foreseeable damages.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

13. Crash Replacement Program

We offer a voluntary crash replacement program for products purchased via our online shop.

If an item is damaged due to a crash or fall while riding, customers may apply for a 40% discount on a replacement item. Approval of such requests is at our sole discretion and requires proof of purchase as well as appropriate evidence of the damage (e.g. photographs).

The crash replacement program applies only to products purchased directly fromwww.owu-cycling.com and is limited to reasonable personal use. It does not apply to normal wear and tear, improper use, or damage caused by washing.

This program is a voluntary service and does not constitute a legal warranty or guarantee. Statutory rights remain unaffected.
